sticky_enabled=&#8221;0&#8243;]<\/p>\n<p>\u793e\u4f1a\u72b6\u51b5\u53d8\u5316\u4e0d\u65ad\uff0c\u4e0e\u5a5a\u59fb\u76f8\u5173\u7684\u6cd5\u4f8b\u4ea6\u968f\u4e4b\u6f14\u53d8\u3002\u8fd1\u5e74\uff0c\u7537\u5973\u53cc\u65b9\u5728\u5a5a\u524d\u6216\u5a5a\u540e\u7b7e\u8ba2\u534f\u8bae\u4e66\u6108\u89c1\u666e\u904d\uff0c\u8fd9\u4e9b\u534f\u8bae\u53ef\u7edf\u79f0\u4e3a\u5a5a\u59fb\u534f\u8bae\u4e66\uff0c\u5373\u7537\u5973\u53cc\u65b9\u7b7e\u8ba2\u5951\u7ea6\uff0c\u8ba2\u660e\u4e00\u65e6\u79bb\u5a5a\uff0c\u53cc\u65b9\u5e94\u8d1f\u7684\u8d23\u4efb\u53ca\u53ef\u4eab\u6709\u7684\u6743\u5229\u3002\u5a5a\u524d\u534f\u8bae\u4e66\u4e8e\u7ed3\u5a5a\u524d\u7b7e\u8ba2\uff0c\u5a5a\u540e\u534f\u8bae\u4e66\u5219\u5728\u5a5a\u540e\u8bae\u5b9a\uff08\u4e0d\u8bba\u53cc\u65b9\u5f53\u65f6\u540c\u4f4f\u6216\u5206\u5c45\uff09\u3002\u5982\u5728\u5206\u5c45\u671f\u95f4\u7b7e\u8ba2\u7684\u534f\u8bae\u4e66\uff0c\u5219\u79f0\u4e3a\u300c\u5206\u5c45\u534f\u8bae\u4e66\u300d\u3002<\/p>\n<p>\u5a5a\u59fb\u534f\u8bae\u4e66\u901a\u5e38\u5305\u542b\u6761\u6b3e\uff0c\u4ee5\u5904\u7406\u4e0b\u5217\u4e8b\u9879\uff1a<\/p>\n<ul>\n<li>\u5206\u914d\u8d22\u4ea7<\/li>\n<li>\u8d61\u517b\u5b89\u6392<\/li>\n<li>\u5176\u4ed6\u8d22\u52a1\u5b89\u6392\uff0c\u5982\u4fe1\u8bac\u3001\u516c\u53f8\u80a1\u4efd\u8f6c\u8ba9\u7b49<\/li>\n<\/ul>\n<p>\u66f4\u590d\u6742\u7684\u534f\u8bae\u4e66\uff0c\u53ef\u5305\u542b\u7279\u5b9a\u6761\u6b3e\uff0c\u8ba2\u660e\u4e00\u65e6\u5a5a\u59fb\u7834\u88c2\u53ef\u5f97\u7684\u91d1\u94b1\u8865\u507f\u3002<\/p>\n<h2>A. \u5a5a\u59fb\u534f\u8bae\u4e66\u7684\u6cd5\u5f8b\u5730\u4f4d<\/h2>\n<p>\u592b\u5987\u5728\u5206\u5c45\u540e\u6216\u5206\u5c45\u671f\u95f4\u8ba2\u5b9a\u7684\u534f\u8bae\u4e66\uff0c\u79f0\u4e3a\u300c\u5206\u5c45\u534f\u8bae\u4e66\u300d\u3002\u6839\u636e\u9999\u6e2f\u6cd5\u4f8b<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/192\/\" target=\"_blank\" rel=\"noopener\">\u7b2c192\u7ae0\u300a\u5a5a\u59fb\u6cd5\u5f8b\u7a0b\u5e8f\u4e0e\u8d22\u4ea7\u6761\u4f8b\u300b<\/a>\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/192\/s14.html\" target=\"_blank\" rel=\"noopener\">\u7b2c14\u6761<\/a>\uff0c\u300c\u5206\u5c45\u534f\u8bae\u4e66\u300d\u5c5e\u6709\u6548\u5951\u7ea6\uff0c\u56e0\u6b64\u5f88\u5e38\u89c1\u3002\u4e0a\u8bc9\u5ead\u4ea6\u66fe\u5728<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/cases\/hkca\/2007\/208.html\" target=\"_blank\" rel=\"noopener\">\u00a0L v C<\/a>\u4e00\u6848\u4e2d\uff0c\u786e\u8ba4\u9664\u975e\u51fa\u73b0\u65e0\u6cd5\u9884\u8ba1\u7684\u8feb\u5207\u60c5\u51b5\uff0c\u5426\u5219\u5206\u5c45\u534f\u8bae\u4e66\u5fc5\u987b\u4e88\u4ee5\u9075\u5b88\u3002<\/p>\n<p>\u4e0d\u8fc7\uff0c\u5982\u592b\u5987\u4e8e\u5206\u5c45\u524d\u4fbf\u8ba2\u5b9a\u534f\u8bae\uff0c\u8fd9\u79cd\u534f\u8bae\u53ea\u5c5e\u4e8e\u5206\u5c45\u524d\u7684\u5a5a\u540e\u534f\u8bae\u4e66\uff0c\u4e0e<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/192\/\" target=\"_blank\" rel=\"noopener\">\u300a\u5a5a\u59fb\u6cd5\u5f8b\u7a0b\u5e8f\u4e0e\u8d22\u4ea7\u6761\u4f8b\u300b<\/a>\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/192\/s14.html\" target=\"_blank\" rel=\"noopener\">\u7b2c14\u6761<\/a>\u4ee5\u4e0b\u7684\u5206\u5c45\u534f\u8bae\u4e66\u4e0d\u540c\u3002\u6cd5\u5ead\u5904\u7406\u6b64\u7c7b\u534f\u8bae\u4e66\u65f6\uff0c\u5c06\u4f1a\u4e0e\u5904\u7406\u5a5a\u524d\u534f\u8bae\u4e66\u4e00\u6837\uff0c\u4f9d\u4ece\u300cRadmacher\u539f\u5219\u300d\u4f5c\u51fa\u8003\u8651\uff0c\u7a0d\u540e\u5c06\u4f1a\u8be6\u8ff0\u3002<\/p>\n<p>\u6cd5\u5ead\u5728\u79bb\u5a5a\u6848\u4ef6\u4e2d\uff0c\u5982\u987b\u6839\u636e<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/192\/\" target=\"_blank\" rel=\"noopener\">\u300a\u5a5a\u59fb\u6cd5\u5f8b\u7a0b\u5e8f\u4e0e\u8d22\u4ea7\u6761\u4f8b\u300b<\/a>\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/192\/s7.html\" target=\"_blank\" rel=\"noopener\">\u7b2c7(1)\u6761<\/a>\u5904\u7406\u6d89\u53ca\u9644\u5c5e\u6d4e\u52a9\u53ca\u5206\u914d\u8d22\u4ea7\u7684\u4e8b\u5b9c\u65f6\uff0c\u4f1a\u8003\u8651\u300c\u6848\u4ef6\u7684\u60c5\u51b5\u300d\u53ca\u53cc\u65b9\u7684\u300c\u884c\u4e3a\u300d\uff0c\u5a5a\u59fb\u534f\u8bae\uff08\u5206\u5c45\u534f\u8bae\u9664\u5916\uff09\u7684\u5185\u5bb9\u53ef\u6210\u4e3a\u8003\u8651\u4e4b\u5217\uff0c\u6cd5\u5ead\u53ef\u80fd\u4f1a\u91c7\u7eb3\u90e8\u5206\u6216\u5168\u90e8\u5185\u5bb9\u3002<\/p>\n<p>\u6cd5\u5ead\u51b3\u5b9a\u662f\u5426\u4f9d\u4ece\u5a5a\u59fb\u534f\u8bae\u4e66\u53d1\u51fa\u76f8\u5e94\u547d\u4ee4\u65f6\uff0c\u516c\u5e73\u539f\u5219\u5c06\u662f\u91cd\u8981\u7684\u8003\u8651\u56e0\u7d20\u3002\u4ee5\u82f1\u56fd\u4e3a\u4f8b\uff0c\u5982\u679c\u53cc\u65b9\uff1a<\/p>\n<ol type=\"1\">\n<li>\u6709\u8bc1\u636e\u663e\u793a\u4ed6\u4eec\u660e\u767d\u534f\u8bae\u7684\u6761\u6b3e\uff1b<\/li>\n<li>\u66fe\u5fb5\u6c42\u72ec\u7acb\u7684\u6cd5\u5f8b\u610f\u89c1\uff1b<\/li>\n<li>\u5982\u5b9e\u4ea4\u4ee3\u6240\u6709\u8d22\u653f\u72b6\u51b5\uff1b<\/li>\n<li>\u81ea\u613f\u7b7e\u7f72\u534f\u8bae\uff0c\u4e0d\u66fe\u53d7\u538b\uff1b<\/li>\n<li>\u6ca1\u6709\u575a\u6301\u5904\u4e8e\u4e3b\u5bfc\uff1b<\/li>\n<\/ol>\n<p>\u800c\u6709\u5173\u534f\u8bae\u7684\u6761\u6b3e\u516c\u5e73\uff0c\u5f53\u5730\u6cd5\u5ead\u5f88\u53ef\u80fd\u4f1a\u6309\u7167\u5a5a\u59fb\u534f\u8bae\u4e66\u7684\u6761\u6b3e\uff0c\u8981\u6c42\u534f\u8bae\u53cc\u65b9\u9075\u4ece\u3002<\/p>\n<p>\u4ee5\u4e0a\u53ea\u5c5e\u57fa\u672c\u6307\u5f15\uff0c\u5e76\u4e0d\u4ee3\u8868\u5168\u90e8\u539f\u5219\u3002\u9664\u975e\u56e0\u5e94\u73b0\u5b9e\u60c5\u51b5\u8981\u6c42\u53cc\u65b9\u9075\u5b88\u534f\u8bae\u7edd\u4e0d\u516c\u5e73\uff0c\u5426\u5219\u53ea\u8981\u53cc\u65b9\u8ba2\u7acb\u534f\u8bae\u65f6\uff0c\u5b8c\u5168\u660e\u767d\u534f\u8bae\u6761\u6b3e\u7684\u542b\u610f\uff0c\u5e76\u81ea\u613f\u7b7e\u7f72\uff08\u53c2\u8003\u82f1\u56fd\u6848\u4f8bRadmacher v Grantino\uff09\uff0c\u6cd5\u5ead\u5fc5\u4f1a\u5bb9\u8bb8\u6267\u884c\u5a5a\u59fb\u534f\u8bae\uff0c\u53d1\u6325\u534f\u8bae\u6761\u6b3e\u7684\u539f\u610f\u3002<\/p>\n<p>\u5728\u9999\u6e2f\uff0c\u7ec8\u5ba1\u6cd5\u9662\u5728\u00a0<em>SPH v SA<\/em>\u00a0 \u4e00\u6848\u4e2d\u91c7\u7eb3\u00a0<em>Radmacher\u00a0<\/em>\u4e3a\u826f\u597d\u6cd5\u5f8b\u3002<\/p>\n<p>&nbsp;<\/p>\n<h2>B.\u5a5a\u524d\u534f\u8bae\u4e66\u53ca\u516c\u5171\u653f\u7b56<\/h2>\n<p>\u793e\u4f1a\u4e00\u76f4\u8ba4\u4e3a\uff0c\u4efb\u4f55\u4e0e\u79bb\u5a5a\u5973\u5b50\u53ca\u5176\u5b50\u5973\u6743\u76ca\u76f8\u5173\u7684\u6cd5\u4f8b\u6761\u6587\uff0c\u5747\u7275\u6d89\u516c\u4f17\u5229\u76ca\uff0c\u56e0\u6b64\uff0c\u5a5a\u524d\u534f\u8bae\u4e66\u4e00\u76f4\u88ab\u89c6\u4f5c\u6709\u8fdd\u516c\u5171\u653f\u7b56\u3002\u82f1\u56fd\u6848\u4f8bBennett v Bennett\u4fbf\u663e\u793a\uff0c\u6cd5\u5ead\u8ba4\u4e3a\u592b\u5987\u79bb\u5a5a\u540e\uff0c\u7537\u65b9\u5982\u6709\u7ecf\u6d4e\u80fd\u529b\u652f\u6301\u5973\u65b9\u53ca\u5b50\u5973\u7684\u751f\u6d3b\uff0c\u5973\u65b9\u53ca\u5176\u5b50\u5973\u4fbf\u4e0d\u5e94\u4f9d\u9760\u653f\u5e9c\u6216\u6148\u5584\u56e2\u4f53\u7684\u63f4\u52a9\u751f\u6d3b\uff0c\u4ee5\u7b26\u5408\u516c\u4f17\u5229\u76ca\u3002<\/p>\n<p>\u4e3e\u4f8b\u8bf4\uff0c\u5982\u7b7e\u8ba2\u5a5a\u524d\u534f\u8bae\u7684\u5176\u4e2d\u4e00\u65b9\u5728\u7b7e\u7f72\u524d\u6ca1\u6709\u5982\u5b9e\u62ab\u9732\u6240\u6709\u4e8b\u5b9e\uff0c\u53cc\u65b9\u79bb\u5a5a\u540e\uff0c\u5973\u65b9\u56e0\u534f\u8bae\u53d8\u5f97\u6349\u895f\u89c1\u8098\uff0c\u6709\u5173\u534f\u8bae\u4fbf\u6709\u8fdd\u516c\u5171\u653f\u7b56\u3002\u53e6\u4e00\u4f8b\u5b50\u662f\uff0c\u5982\u53cc\u65b9\u7684\u7ecf\u6d4e\u72b6\u51b5\u4e8e\u5a5a\u540e\u6709\u91cd\u5927\u6539\u53d8\uff0c\u4e0d\u8bba\u8f6c\u53d8\u5b70\u597d\u5b70\u574f\uff0c\u4ed6\u4eec\u5f53\u521d\u8ba2\u7acb\u7684\u5a5a\u524d\u534f\u8bae\u4fbf\u53ef\u80fd\u4e0d\u518d\u7b26\u5408\u516c\u5e73\u539f\u5219\uff0c\u6216\u53ef\u80fd\u4e0d\u518d\u53cd\u6620\u53cc\u65b9\u4e8e\u5a5a\u540e\u7684\u751f\u6d3b\u6c34\u5e73\u3002<\/p>\n<p>\u53ca\u540e\u81f3\u5ba1\u7406Radmacher\u4e00\u6848\u65f6\uff0c\u5f53\u65f6\u82f1\u56fd\u6cd5\u5ead\u6307\u51fa\uff0c\u5a5a\u524d\u534f\u8bae\u5e76\u6ca1\u6709\u8fdd\u80cc\u516c\u5171\u653f\u7b56\u3002\u4e0d\u8fc7\uff0c\u82f1\u56fd\u6cd5\u5ead\u7684\u88c1\u51b3\u5bf9\u9999\u6e2f\u6cd5\u5ead\u6765\u8bf4\uff0c\u53ea\u80fd\u8d77\u53c2\u8003\u4f5c\u7528\u3002\u518d\u8005\uff0c\u5a5a\u524d\u534f\u8bae\u4ea6\u4e0d\u80fd\u7981\u6b62\u4efb\u4f55\u4eba\u5411\u6cd5\u9662\u7533\u8bf7\u547d\u4ee4\uff0c\u4ee5\u89e3\u51b3\u4e0e\u8d22\u52a1\u76f8\u5173\u7684\u95ee\u9898\u3002\u5728\u9999\u6e2f\uff0c\u7ec8\u5ba1\u6cd5\u9662\u5728\u00a0<em>SPH v
