\u4e0e\u88ad\u51fb\u76f8\u5173\u7684\u7f6a\u884c<\/h2>\n<p>\u82e5\u4efb\u4f55\u4eba\u56e0\u666e\u901a\u88ad\u51fb\uff0c\u8fdd\u53cd\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/212\" target=\"_blank\" rel=\"noopener\">\u300a\u4fb5\u5bb3\u4eba\u8eab\u7f6a\u6761\u4f8b\u300b<\/a>\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/212\/s40.html\" target=\"_blank\" rel=\"noopener\">\u7b2c40\u6761<\/a>\u00a0\u800c\u88ab\u5b9a\u7f6a\uff0c\u6700\u9ad8\u53ef\u5904\u76d1\u7981\u4e00\u5e74\u3002<\/p>\n<p>\u5f53\u7f20\u6270\u8005\u84c4\u610f\u6216\u9c81\u83bd\u5730\u4f5c\u51fa\u4e00\u4e9b\u884c\u4e3a\uff0c\u4ee4\u53d7\u5bb3\u4eba\u62c5\u5fc3\u4f1a\u5373\u65f6\u53d7\u5230\u975e\u6cd5\u6b66\u529b\u5bf9\u5f85\uff0c\u4fbf\u89e6\u72af\u88ad\u51fb\u7f6a\u3002\u4e0d\u8fc7\uff0c\u5982\u7f20\u6270\u8005\u53ea\u4f5c\u51fa\u5a01\u5413\u6027\u4e3e\u52a8\u6216\u53d1\u8868\u76f8\u5173\u7684\u8a00\u8bcd\uff0c\u82e5\u6ca1\u6709\u6d89\u53ca\u5373\u65f6\u66b4\u529b\uff0c\u5219\u4e0d\u7b97\u88ad\u51fb\u3002\u8ddf\u8e2a\u53d7\u5bb3\u4eba\u6216\u5728\u53d7\u5bb3\u4eba\u4f4f\u6240\u95e8\u5916\u6e38\u8361\uff0c\u6216\u5728\u6ca1\u6709\u4f7f\u7528\u6b66\u529b\u4e0b\u800c\u8fb1\u9a82\u548c\u717d\u52a8\u53d7\u5bb3\u4eba\uff0c\u5e76\u4e0d\u7b49\u540c\u88ad\u51fb\u3002<\/p>\n<p>\u9664\u4e86\u53d7\u5bb3\u4eba\u62c5\u5fc3\u81ea\u5df1\u5373\u65f6\u53d7\u5230\u975e\u6cd5\u6b66\u529b\u5bf9\u5f85\u5c5e\u300c\u88ad\u51fb\u300d\u5916\uff0c\u300c\u6bb4\u6253\u300d\u4ea6\u5c5e\u300c\u88ad\u51fb\u300d\u3002\u6bb4\u6253\u662f\u4e00\u4e2a\u4eba\u5728\u672a\u7ecf\u540c\u610f\u4e0b\u5bf9\u53e6\u4e00\u4eba\u4f5c\u51fa\u975e\u6cd5\u7684\u8eab\u4f53\u63a5\u89e6\uff0c\u53ea\u8981\u80fd\u8bc1\u660e\u5f53\u4e2d\u7275\u6d89\u4f7f\u7528\u6b66\u529b\uff0c\u4fbf\u6bcb\u987b\u8bc1\u660e\u88ab\u544a\u6709\u610f\u56fe\u4f24\u4eba\u3001\u6216\u5176\u884c\u4e3a\u5bfc\u81f4\u6216\u5a01\u80c1\u4f1a\u9020\u6210\u8eab\u4f53\u635f\u5bb3\u3002\u5355\u5355\u5728\u672a\u7ecf\u540c\u610f\u4e0b\u63a5\u89e6\u3001\u6216\u6ca1\u6709\u5408\u6cd5\u7406\u7531\u4e0b\u89e6\u6478\u5bf9\u65b9\uff0c\u5df2\u7b97\u662f\u88ad\u51fb\u3002<\/p>\n<p>\u8b66\u65b9\u53ef\u5f15\u7528\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/212\" target=\"_blank\" rel=\"noopener\">\u300a\u4fb5\u5bb3\u4eba\u8eab\u7f6a\u6761\u4f8b\u300b<\/a>\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/212\/s40.html\" target=\"_blank\" rel=\"noopener\">\u7b2c40\u6761<\/a>\u00a0\u68c0\u63a7\u7f20\u6270\u8005\uff0c\u4ee5\u534f\u52a9\u53d7\u5bb3\u4eba\u3002\u63a7\u65b9\u987b\u8bc1\u660e\u53d7\u5bb3\u4eba\u88ab\u7f20\u6270\u8005\u65bd\u4ee5\u6b66\u529b\u5a01\u80c1\uff0c\u6216\u4e8c\u4eba\u4e4b\u95f4\u7684\u8ddd\u79bb\uff0c\u8db3\u4ee5\u8ba9\u53d7\u5bb3\u4eba\u611f\u5230\u5373\u65f6\u5a01\u80c1\u3002\u8fd9\u8981\u89c6\u4e4e\u6bcf\u5b97\u6848\u4ef6\u7684\u4e8b\u5b9e\u95ee\u9898\u3002<\/p>\n<p>\u6839\u636e\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/212\" target=\"_blank\" rel=\"noopener\">\u300a\u4fb5\u5bb3\u4eba\u8eab\u7f6a\u6761\u4f8b\u300b<\/a>\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/212\/s39.html\" target=\"_blank\" rel=\"noopener\">\u7b2c39\u6761<\/a>\u00a0\uff0c\u5982\u679c\u88ad\u51fb\u5df2\u5bf9\u53d7\u5bb3\u4eba\u6784\u6210\u5b9e\u9645\u7684\u8eab\u4f53\u4f24\u5bb3\uff0c\u53ef\u88ab\u63a7\u88ad\u51fb\u81f4\u9020\u6210\u8eab\u4f53\u4f24\u5bb3\u7f6a\uff0c\u5e76\u53ef\u5904\u6bd4\u666e\u901a\u88ad\u51fb\u6216\u6bb4\u6253\u7f6a\u66f4\u9ad8\u7684\u5211\u7f5a\u3002\u4e00\u65e6\u8bc1\u5b9e\u6709\u88ad\u51fb\u6216\u6bb4\u6253\u884c\u4e3a\uff0c\u4f59\u4e0b\u7684\u4fbf\u8981\u8bc1\u660e\u76f8\u5173\u884c\u4e3a\u6709\u5426\u9020\u6210\u5b9e\u9645\u8eab\u4f53\u635f\u5bb3\u3002<\/p>\n<p>\u4e0d\u8fc7\uff0c\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/212\/s39.html\" target=\"_blank\" rel=\"noopener\">\u7b2c39\u6761<\/a>\u00a0\u53ef\u9488\u5bf9\u7684\u7f20\u6270\u884c\u4e3a\u6709\u9650\u3002\u9996\u5148\uff0c\u8981\u8bc1\u660e\u76f8\u5173\u884c\u4e3a\u7b26\u5408\u88ad\u51fb\u7684\u5b9a\u4e49\uff0c\u5176\u6b21\u8fd8\u8981\u8bc1\u660e\u8be5\u884c\u4e3a\u5df2\u6784\u6210\u4ed6\u4eba\u5b9e\u9645\u8eab\u4f53\u4f24\u5bb3\u3002\u5f88\u591a\u65f6\u5019\uff0c\u7f20\u6270\u8005\u53ea\u662f\u5c3e\u968f\u53d7\u5bb3\u4eba\uff0c\u6216\u5411\u5bf9\u65b9\u9020\u51fa\u7c97\u9119\u52a8\u4f5c\u6216\u5927\u53eb\u5927\u56b7\u793a\u7231\uff0c\u8fd9\u4e9b\u90fd\u4e0d\u7b97\u4e0a\u662f\u88ad\u51fb\u3002<\/p>\n<h2>B. \u8c0b\u6740\u3001\u4f01\u56fe\u8c0b\u6740\u548c\u8bef\u6740<\/h2>\n<p>\u7f20\u6270\u884c\u4e3a\u6700\u4ee4\u4eba\u5fe7\u8651\u662f\u5b83\u6709\u53ef\u80fd\u6f14\u53d8\u6210\u66b4\u529b\u4e8b\u4ef6\u3002\u8fd9\u53ef\u7531\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/cases\/hkca\/2007\/99.html\" target=\"_blank\" rel=\"noopener\">\u9999\u6e2f\u7279\u522b\u884c\u653f\u533a\u8bc9\u5f90\u67f1\u5929\u6848<\/a>\u00a0\u4e3e\u4f8b\u8bf4\u660e\u4e4b\u3002\u88ab\u544a\u5f90\u67f1\u5929\u4e3a\u8b66\u52a1\u4eba\u5458\uff0c\u4e0e\u5973\u4e8b\u4e3b\u53d1\u5c55\u4e00\u5e74\u591a\u7684\u60c5\u4fa3\u5173\u7cfb\uff0c\u76f4\u81f3\u5979\u5411\u5f90\u63d0\u51fa\u5206\u624b\u800c\u544a\u7ec8\u3002\u7531\u4e8e\u5f90\u96be\u4ee5\u63a5\u53d7\u5973\u4e8b\u4e3b\u7684\u79bb\u5f00\uff0c\u4ed6\u5f00\u59cb\u7f20\u6270\u5bf9\u65b9\uff0c\u4e0d\u65ad\u6253\u7535\u8bdd\u5230\u5979\u7684\u5bd3\u6240\u548c\u5de5\u4f5c\u5730\u65b9\u3002\u8b66\u65b9\u6536\u5230\u6295\u8bc9\u540e\uff0c\u5f90\u88ab\u63a7\u4e09\u9879\u6e38\u8361\u81f3\u4ed6\u4eba\u62c5\u5fc3\u7f6a\uff08\u5bfc\u81f4\u53d7\u5bb3\u4eba\u5408\u7406\u5730\u62c5\u5fc3\u81ea\u5df1\u7684\u5b89\u5168\u6216\u5229\u76ca\uff09\uff0c\u8fdd\u53cd\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/200\" target=\"_blank\" rel=\"noopener\">\u7b2c200\u7ae0\u300a\u5211\u4e8b\u7f6a\u884c\u6761\u4f8b\u300b<\/a>\u00a0<a rel=\"noopener\">\u7b2c160(3)\u6761<\/a>\u00a0\u3002\u5f90\u83b7\u51c6\u4fdd\u91ca\uff0c\u6761\u4ef6\u662f\u4e0d\u5f97\u63a5\u8fd1\u6216\u9a9a\u6270\u5973\u4e8b\u4e3b\u3002\u4f46\u8fd9\u6bb5\u671f\u95f4\uff0c\u4ed6\u4e70\u4e86\u5200\uff0c\u5e76\u5e26\u7740\u5200\u524d\u5f80\u5973\u4e8b\u4e3b\u7684\u5bd3\u6240\u627e\u5979\uff0c\u5973\u4e8b\u4e3b\u4e0d\u52a0\u7406\u4f1a\uff0c\u5f90\u5a01\u80c1\u8981\u5728\u5979\u9762\u524d\u81ea\u5c3d\uff0c\u53c8\u58f0\u8a00\u8981\u5973\u4e8b\u4e3b\u4f59\u751f\u90fd\u8bb0\u7740\u4ed6\u3002\u5973\u4e8b\u4e3b\u79bb\u5f00\u5bd3\u6240\u5bfb\u627e\u516c\u5171\u7535\u8bdd\uff0c\u5f90\u7ee7\u7eed\u5c3e\u968f\uff0c\u5979\u5411\u5f90\u8bf4\u5df2\u7ecf\u62a5\u8b66\uff0c\u529d\u55bb\u4ed6\u79bb\u5f00\u4e0d\u9042\uff0c\u53cd\u88ab\u5f90\u7528\u5200\u523a\u5176\u9888\u548c\u80f8\u90e8\u3002\u5973\u4e8b\u4e3b\u56e0\u4f24\u6b7b\u4ea1\uff0c\u5f90\u88ab\u63a7\u8c0b\u6740\u3002\u5f90\u7533\u8bf7\u4e0a\u8bc9\uff0c\u4ed6\u4ee5\u795e\u5fd7\u5931\u5e38\u51cf\u8d23\u4e3a\u7406\u7531\uff0c\u83b7\u6279\u51c6\u5c06\u63a7\u7f6a\u7531\u8c0b\u6740\u6539\u4e3a\u8bef\u6740\uff0c\u6700\u7ec8\u88ab\u5224\u7ec8\u8eab\u76d1\u7981\uff0c\u987b\u670d\u6700\u4f4e\u5211\u671f12\u5e74\uff08\u8bef\u6740\u7f6a\u6700\u9ad8\u53ef\u5904\u7ec8\u8eab\u76d1\u7981\uff09\u3002\u5ba1\u8baf\u4ea6\u63ed\u9732\u5f90\u8fc7\u5f80\u66fe\u5411\u53e6\u5916\u4e24\u540d\u524d\u5973\u53cb\u4f5c\u51fa\u76f8\u4f3c\u7684\u7f20\u6270\u884c\u4e3a\uff0c\u5176\u4e2d\u4e00\u6b21\u66f4\u62ff\u7740\u6267\u52e4\u7528\u7684\u624b\u67aa\u6307\u5411\u81ea\u5df1\u7684\u5934\u90e8\uff0c\u5a01\u80c1\u8981\u4e0e\u524d\u5973\u53cb\u590d\u5408\uff0c\u5426\u5219\u4fbf\u81ea\u6740\u3002<\/p>\n<p>\u8fd9\u5b97\u6848\u4ef6\u7a81\u663e\u4e86\u4fdd\u969c\u7f20\u6270\u8005\u7684\u56f0\u96be\uff0c\u7279\u522b\u662f\u67d0\u4e9b\u6d89\u6848\u4eba\u80fd\u591f\u7528\u51cf\u8d23\u795e\u5fd7\u5931\u5e38\u6216\u5176\u4ed6\u7cbe\u795e\u95ee\u9898\u4f5c\u6297\u8fa9\u7406\u7531\u3002\u5728\u73b0\u5b9e\u4e2d\uff0c\u82e5\u7136\u5f90\u6ca1\u6709\u83b7\u51c6\u4fdd\u91ca\uff0c\u8fd8\u67d9\u76d1\u623f\u770b\u7ba1\u81f3\u5ba1\u8baf\u7ec8\u7ed3\u53ca\u5224\u5211\uff0c\u6848\u4e2d\u5973\u4e8b\u4e3b\u4fbf\u5f97\u4ee5\u4fdd\u547d\u3002<\/p>\n<p>\u6839\u636e\u00a0<a
